PARTICIPATION WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

Please read carefully before signing. This is a legal document that affects your legal rights.

This Agreement is entered into by and between Infinity Grappling LLC, doing business as Infinite Grappling (“Infinity Grappling,” “Infinite Grappling,” “Gym,” or “Company”) and the undersigned participant (“Participant”), or the Participant’s parent or legal guardian if the Participant is under 18 years of age.

In consideration for being allowed to participate in any activities at Infinity Grappling LLC dba Infinite Grappling, the Participant agrees as follows:

1. Activities Covered

This Agreement applies to all participation in activities offered by the Gym, including but not limited to:

• Brazilian Jiu-Jitsu
• No-Gi Grappling
• Wrestling
• Judo
• Mixed Martial Arts (MMA)
• Self-defense instruction
• Strength and conditioning
• Weightlifting
• Fitness classes
• Open mat sessions
• Sparring and live training
• Private lessons
• Seminars
• Competitions
• Youth programs
• Use of locker rooms and common areas
• Use of all exercise equipment and training facilities
• Any future activities conducted by the Gym.

2. Assumption of Risk

I understand that participation in martial arts and strength training involves inherent and unavoidable risks.

These risks include, but are not limited to:

• Cuts and abrasions
• Bruises
• Sprains
• Muscle strains
• Torn ligaments or tendons
• Broken bones
• Joint injuries
• Finger and toe injuries
• Neck injuries
• Back injuries
• Spinal injuries
• Head injuries
• Concussions
• Choking or temporary loss of consciousness during grappling
• Eye injuries
• Dental injuries
• Heat-related illness
• Equipment failure
• Injuries caused by other participants
• Paralysis
• Permanent disability
• Death

I understand these injuries may occur despite proper supervision, instruction, equipment, or safety precautions.

I voluntarily and knowingly assume all risks associated with participation.

3. Medical Condition

I certify that I am physically capable of participating.

I understand it is my responsibility to consult a physician before participating if I have any health concerns.

I agree to immediately stop participation and notify an instructor if I become injured or experience pain, dizziness, illness, or any medical issue.

4. Release of Liability

To the fullest extent permitted by Nevada law, I voluntarily release, waive, discharge, and covenant not to sue Infinity Grappling LLC dba Infinite Grappling, including its owners, members, managers, employees, instructors, coaches, volunteers, independent contractors, affiliates, landlords, and agents, from any and all liability, claims, demands, actions, damages, losses, costs, or expenses arising from my participation in the Activities, including claims resulting from ordinary negligence.

This release does not apply to gross negligence, reckless conduct, or intentional misconduct where prohibited by law.

5. Strength and Conditioning Area

I understand that the Gym contains free weights, barbells, squat racks, benches, pull-up bars, dumbbells, kettlebells, resistance bands, cardio equipment, and other exercise equipment.

I agree that I will:

• Use equipment responsibly.
• Ask staff for assistance if I do not understand how to use equipment.
• Inspect equipment before use.
• Return equipment after use.
• Use safety clips or collars when appropriate.
• Never intentionally misuse equipment.
• Immediately report damaged equipment.
• Exercise within my own physical abilities.

I understand that I use all equipment entirely at my own risk.

6. Participant Responsibilities

I agree to:

• Follow all instructor directions.
• Train safely and respectfully.
• Practice good hygiene.
• Wear appropriate athletic clothing.
• Keep fingernails and toenails trimmed.
• Remove jewelry before training.
• Report communicable skin conditions or illnesses before participating.
• Not participate while under the influence of drugs or alcohol.
• Treat coaches, staff, and fellow students with respect.

The Gym reserves the right to suspend or terminate my membership for unsafe, disruptive, or inappropriate behavior.

7. Emergency Medical Treatment

If I become injured or incapacitated, I authorize Infinity Grappling LLC dba Infinite Grappling to obtain emergency medical treatment on my behalf if deemed necessary.

I understand I am solely responsible for any resulting medical expenses.

8. Personal Property

The Gym is not responsible for lost, stolen, or damaged personal property, including clothing, electronics, jewelry, wallets, or vehicles.

9. Photography and Video

I grant Infinity Grappling LLC dba Infinite Grappling permission to photograph or record me during classes, seminars, competitions, or events.

I authorize the Gym to use these photographs or videos for advertising, promotional, educational, or social media purposes without compensation.

10. Indemnification

I agree to indemnify, defend, and hold harmless Infinity Grappling LLC dba Infinite Grappling from any claims, lawsuits, liabilities, damages, attorney’s fees, or expenses arising from my own actions or conduct while participating in the Activities.

11. Compliance with Gym Rules

I agree to comply with all posted rules and any verbal instructions given by Gym staff.

Failure to follow Gym rules may result in suspension or termination of membership without refund.

12. Severability

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Governing Law

This Agreement shall be governed by the laws of the State of Nevada.

Any legal action relating to this Agreement shall be brought in the appropriate state or federal court located in Clark County, Nevada, unless otherwise required by law.

14. Entire Agreement

This Agreement constitutes the entire understanding between the parties concerning assumption of risk and release of liability and supersedes all prior discussions or agreements regarding these subjects.

15. Acknowledgment

I certify that:

• I have carefully read this Agreement.
• I fully understand its contents.
• I understand I am giving up important legal rights by signing it.
• I sign this Agreement voluntarily and without coercion.
• I intend for this Agreement to be binding upon myself, my heirs, family members, personal representatives, successors, and assigns.

PARENT OR LEGAL GUARDIAN (Required for Participants Under 18)

I certify that I am the parent or legal guardian of the minor participant. I have read this Agreement, understand it, and agree to its terms on behalf of myself and the minor participant. I further agree to indemnify and hold harmless Infinity Grappling LLC dba Infinite Grappling from any claims brought by or on behalf of the minor participant to the extent permitted by law.
